ISLAMABAD: Supreme Court (SC) has summoned details of assets in respect of Asif Zardari and his children within 15 days. A 3-member bench of SC presided over by Chief Justice of Pakistan (CJP) Mian Saqib Nisar took up for hearing review petition filed by former president Asif Ali Zardari against August 29 decision of SC summoning details of his assets in relation to the National Reconciliation Ordinance (NRO) case.
The court directed Asif Ali Zardari to file details of his inherited assets. Farooq H Naik counsel for Asif Ali Zardari requested the court to seek details of assets for five years only and not to summon details of assets for 10 years. Law is only meant for five years.
The court while rejecting Farooq H Naik plea for filing assets details for five years remarked details of assets should be provided for 10 years. Naik said details of assets of autonomous children should also not be summoned. Naik argued that Asif Ali Zardari was co-accused in 8 cases and affidavit was sought from him under clause 3 of article 184 of the constitution.
CJP remarked: “Don’t give affidavit if you don’t want to give. Public money is for public welfare . Therefore we have used article 184 (3). Guardianship of sons come to end when they grow mature as per law. While the guardianship of the daughters end after their marriage. Seeking details of assets is not conducting trial. Asif Zardari should be happy that he had got chance to defend him. The trial of Benazir Bhutto shahadat took place during Asif Zardari era. But we feel that correct trial was not conducted.
Justice Ijaz ul Ahsan inquired from Farooq H Naik “have you destroyed all the record by yourself.
Naik said “I have indicated to possibility of record.
CJP remarked: “This is not issue of corruption. We are increasing our ambit”. Naik said “my client remained in jail from 1997 to 2005 and details of assets of those children are being sought who are not under guardianship; of my client. The trial of Mohtarma Benazir Bhutto is being conducted.
CJP remarked: “We can not even think of trial of Mohtarma. Mohtarma was martyred.
The second counsel Latif Khosa said appeals against acquittal of the accused are pending hearing in SC.
CJP remarked: “You remain in court the whole day long. Tell us we will hear the petition.
The court while summoning details of assets of Asif Zardari, his children Bilawal, Asifa and Bakhtawar within 15 days adjourned the hearing of the case.
